Terms and Conditions of Service
These Terms and Conditions (“Agreement”) govern the rental and use of vehicles provided by NY Party Rides (“Company,” “we,” “our,” or “us”). By booking any reservation with the Company, the customer (“Client,” “you,” or “your”) acknowledges and agrees to be bound by the following terms in their entirety.
1. Payment Policy
1.1 A non-refundable deposit is required at the time of booking to secure all reservations. Deposits shall not, under any circumstances, be refunded.
1.2 The remaining balance is due in full on the scheduled date of service and must be paid prior to the commencement of transportation.
1.3 A valid credit or debit card must be maintained on file for all bookings. Said card shall serve as security for damages, cleaning fees, or other charges that may arise under this Agreement.
2. Cancellation Policy
2.1 All cancellation requests must be submitted in writing within thirty (30) calendar days of the initial booking date. Only cancellations made within this timeframe will be eligible for a refund.
2.2 All approved refunds shall be issued exclusively as a credit applicable to future services with the Company. No monetary refunds shall be granted.
2.3 Cancellation requests submitted after the thirty (30) day period will not be eligible for any refund or credit.
3. Vehicle Availability
3.1 The Company will make reasonable efforts to provide the specific vehicle reserved by the Client.
3.2 In the event the reserved vehicle becomes unavailable due to breakdown, mechanical failure, scheduled maintenance, or other causes beyond the Company’s control, the Company reserves the right to substitute the reserved vehicle with another of equal or greater value and capacity at no additional cost to the Client.
3.3 The Client acknowledges and accepts that such substitution shall not constitute a breach of contract.
4. Damages and Liability
4.1 The Client shall be held financially responsible for any and all damages to the vehicle, its equipment, or furnishings caused by the Client or the Client’s guests.
4.2 The credit card on file shall be charged for the cost of all repairs, replacements, or excessive cleaning fees required as a result of damage, misuse, or negligence.
4.3 The Company shall not be liable for the loss, theft, or damage of any personal property brought onto the vehicle by the Client or the Client’s guests.
5. Passenger Conduct
5.1 Smoking, underage drinking, and the use or possession of illegal substances are strictly prohibited in all vehicles.
5.2 The Client is responsible for ensuring that all passengers comply with applicable laws, as well as Company rules and driver instructions.
5.3 The Company reserves the right to immediately terminate service, without refund, in the event of unruly, unsafe, or unlawful conduct by the Client or any passenger.
6. Limitation of Liability
6.1 The Company shall not be liable for delays, interruptions, or cancellations caused by acts of God, weather conditions, traffic, accidents, governmental regulations, or other events beyond its reasonable control.
6.2 The Company shall not be held responsible for missed engagements, lost time, or incidental or consequential damages arising from service delays or substitutions.
6.3 The maximum liability of the Company, under any circumstances, shall not exceed the total amount paid by the Client for the reservation in question.
7. Governing Law and Jurisdiction
7.1 This Agreement shall be governed by and construed in accordance with the laws of the State of New York.
7.2 Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in New York State.
8. Acceptance of Terms
By booking and paying for a reservation, the Client affirms that they have read, understood, and agree to be legally bound by these Terms and Conditions.
